ORGANIC CLAIMS AND CANADA’S NEW FEDERAL REGIME

On June 30, 2009, proposed new Organic Products Regulations, 2009 (“Organic Regulations”) established under the Canada Agricultural Products Act (“CAPA”) are to come into force to provide a national regulatory scheme to certify and label organic food.
The proposed Organic Regulations were published in Canada Gazette Part I on February 5, 2009, with a 75-day comment period. The Organic Regulations are to be administered by the Canadian Food Inspection Agency (“CFIA”), although CFIA will be using other bodies, discussed below, to do much of the legwork.

PROCEDURES FOR THE ESTABLISHMENT OF WHOLLY FOREIGN OWNED ADVERTISING VENTURES SIMPLIFIED WITH NEW REGULATIONS

2008 saw several new developments regarding Advertising in China. Chief amongst these was the changes made to the regulations regarding foreign ownership of advertising companies. The Provisions on the Administration of Foreign-funded Advertising Enterprises, in effect since Octoberreplaced the prior regulations of 2004 and altered the requirements for establishing Wholly Foreign Owned Advertising Companies in China.
