BELGIUM'S NEW MOTOR VEHICLE ADVERTISING ACT
February 2002

GALA member Jan Ravelingien of Marx Van Ranst Vermeersch & Partners in Belgium reports that the The Belgian State Gazette of February 14, 2002 published an Act on Motor Vehicle Advertising.

The Act, which went into effect immediately, essentially provides the following:

• In an effort to improve traffic safety, each advertisement for a motor vehicle must contain a warning on driver responsibility for safe driving behavior;

• An advertiser may be criminally liable for violating the Act and fines may be imposed by the Belgian Institute for Traffic and Safety; and

• Subordinate legislation will regulate the precise language of the warning message.
